Terms and Conditions

Please note that these are my general terms and conditions.  For each project that I undertake, specific terms and conditions will be produced which fit the project.  These will be agreed by both parties before the project is undertaken.

1 Confidentiality

All assignments and client contact details are treated as strictly confidential. Naomi Bennett will never intentionally divulge, disclose or communicate confidential client information.

2 Charging

2.1 Naomi Bennett's standard and advanced hourly rates apply to tasks carried out from Naomi Bennett's premises. Any assignment that involves leaving the premises will be subject to an out of office rate. This is a higher rate subject to negotiation.

2.2 The hourly rate is billed in increments of 15 minutes, with time charged to the nearest quarter of an hour.

2.3 Stationery, telephone, fax, postage, CDs/DVDs, printing costs and all other expenses will be charged separately at cost price and may need to be paid for in advance. I can provide a list of charges

2.4 Time spent on an assignment, including liaison with a client by telephone, fax, email or during face to face meetings, will be charged at the appropriate hourly rate.

2.5 Registration of client details and initial enquiries regarding a new assignment (and at Naomi Bennett's own discretion, a meeting with a new client) is complimentary. Any time taken carrying out work experimentally at the client's request, or discussing an assignment in detail shall be charged at the appropriate hourly rate.

3 Estimates & Deposits

3.1 A signed acceptance of the Terms and Conditions is required before work will commence. Estimates are provided on request. Naomi Bennett's hourly fee structure ensures that clients only pay for the time it has taken to complete a task (plus any disbursements). Therefore, estimates as opposed to quotations are provided. If the client requests work which is out of scope, this will be charged in addition to any agreed fee, at an amount agreed between the parties.

3.2 For disbursements estimated to be over £50, Naomi Bennett reserves the right to request payment of up to 50% before work commences. For disbursements estimated to be over £100, Naomi Bennett reserves the right to request payment in full before work commences.

3.3 Naomi Bennett reserves the right to request the full estimated amount is made in advance of work commencing.

4 Invoices

4.1 Invoices are due for payment within 14 days.

4.2 Invoices will be sent to the email and/or any other communication address provided.

4.3 Should the client instruct Naomi Bennett to stop work or request a break of more than 14 days, regardless of the circumstances, Naomi Bennett reserves the right to issue invoices for all work completed and disbursements incurred to date.

4.4 Should communication between the client and Naomi Bennett cease for more than 28 days, Naomi Bennett reserves the right to issue invoices for all work completed and disbursements incurred to date.

5 Payment

5.1 Payment is to be made by cheque or bank transfer (bill payment). If the bank refuses a cheque, the client will be responsible for all bank charges.

6 Retainer

6.1 For retainer packages, payment for each month is made in advance. Invoices are issued at the end of the month for the following month and payment is due immediately by bank transfer.

6.2 Clients wishing to cancel a retainer package must give minimum notice of one month.

7 Loss/Damage of Client Property

7.1 Due to the varied nature of Naomi Bennett's work, it is not possible to insure clients' property. Clients must make copies of all data and information, and insure equipment and items for use away from their own premises, prior to giving them to Naomi Bennett.

7.2 Naomi Bennett cannot be held responsible for any loss, damage, theft etc of data, projects, equipment or any items relating to assignment, during transit to/from, or whilst at Naomi Bennett's premises.

8 Errors and Amendments

8.1 Final proof reading and checking of all work supplied is the responsibility of the client. Naomi Bennett must be notified of any errors within seven days of receipt of completed work. Amendments or alterations, as requested by the client, will be charged at the appropriate hourly rate. Errors generated by Naomi Bennett will be rectified free of charge.

9 Insurance, Health & Safety

9.1 Naomi Bennett is fully insured to complete work from her home address.

9.2 For insurance and safety reasons, personal visits to Naomi Bennett's premises cannot be accommodated. Therefore all meetings in relation to work will take place either at client offices, or at agreed third party premises.

10 Email Traffic and Security

10.1 Due to computer viruses, all incoming emails will be scanned. Naomi Bennett reserves the right to delete any suspicious emails or attachments. Clients must ensure that they clearly identify themselves in all email correspondence and name attachments appropriately.
